01Who we are and acceptance
BadgeClaimed (“BadgeClaimed,” “we,” “us”) provides the badgeclaimed.com website, the app.badgeclaimed.com application, the public profiles at profiles.badgeclaimed.com, and the BadgeClaimed API (together, the “service”). These terms are an agreement between you and BadgeClaimed about its use.
If you use the service on behalf of an organization, you represent that you have authority to accept these terms for it; in that case, “you” includes that organization. If you do not agree with these terms, do not use the service.
02The service
BadgeClaimed lets organizations (“issuers”) design badge templates, issue verifiable digital credentials, and deliver them to people (“earners”), who can store them in their wallet, share them, and display them on a public profile. Anyone can verify a credential with the link or file that comes with it.
Credentials follow the Open Badges 3.0 standard. Their content (the achievement, the criteria, the earner’s name, and the issuer’s details) is defined by the issuer, not by BadgeClaimed.
03Your account
- You must provide accurate information and keep it up to date.
- You are responsible for protecting your password and for activity on your account. If you sign in with Google, Google’s terms also apply.
- Let us know right away at info@badgeclaimed.com if you believe someone used your account without permission.
- You must be at least 21 years old to create an account.
04If you issue credentials
As an issuer, you are responsible for the credentials you issue. In particular, you agree to:
- Issue only on behalf of organizations you represent and use only names, logos, and trademarks you have the right to use.
- Make sure each credential reflects a real achievement with accurate criteria, and deliver it only to the person who earned it.
- Have a legal basis to process the earner data you upload, such as names and email addresses, and inform earners that they will receive their credential through BadgeClaimed.
- Promptly revoke any credential that is no longer valid or was issued by mistake.
We may verify an issuer’s identity and ask for documents that prove its relationship with the organization it claims to represent. If it cannot prove it, we may suspend its issuing.
05If you earn credentials
You can store, download, and share the credentials you receive. In your account settings, you decide whether your profile and each badge are public or private.
The issuer may revoke a credential. When it does, verification shows that the credential is no longer valid.
06Acceptable use
You may not use the service to:
- Issue false or misleading credentials, or impersonate another person or organization.
- Alter credentials, fake verifications, or make a revoked credential appear valid.
- Send unsolicited email or publish content that is illegal, offensive, or infringes the rights of others.
- Access accounts, data, or systems without permission, run security tests without written authorization, introduce malicious code, or overload the service.
- Scrape data in bulk or resell the service without an agreement with us.
07Plans, credits, and payments
- The Starter plan is free, within the limits published on the website. The Pro and Enterprise plans and the purchase of issuing credits are paid at the price shown at checkout or the price we agree on in writing.
- Card payments are processed by Stripe. We do not store your full card details.
- Prices do not include taxes unless stated otherwise.
- The term and renewal of each plan are those shown when you purchase it or those in the signed agreement.
- Payments are non-refundable unless the law requires otherwise. If you were charged for something you did not receive, such as credits that do not appear in your account, email us at info@badgeclaimed.com and we will fix it or refund you.
08Intellectual property
The BadgeClaimed software, design, and trademarks belong to us or our licensors. We grant you a limited, non-exclusive, non-transferable permission to use the service under these terms.
Your content (logos, badge designs, text, and data) remains yours. You allow us to host, process, and display it only as needed to provide the service, for example so a credential can be displayed and verified.
09Availability and verification
We work to keep the service and credential verification available at all times, but there may be interruptions due to maintenance, failures, or causes beyond our control.
We do not guarantee that an employer, institution, or other platform will accept a credential: that decision belongs to each third party. We may change or improve features of the service; if a change removes an essential feature of a paid plan, we will give you reasonable advance notice.
10Suspension and account closure
You can close your account at any time from your settings or by emailing us at info@badgeclaimed.com. We may suspend or close an account that breaches these terms, puts other users or the service at risk, or when the law requires it. When possible, we will notify you in advance and tell you why.
What happens to your data when you close your account is explained in the Privacy Policy.
11Disclaimer of warranties
The service is provided “as is” and “as available.” To the extent permitted by law, we make no implied warranties of merchantability, fitness for a particular purpose, or non-infringement. BadgeClaimed does not verify the accuracy of the achievements each issuer certifies.
12Limitation of liability
To the extent permitted by law, BadgeClaimed is not liable for indirect damages, lost profits, or loss of data or opportunities arising from the use of the service. Our total liability for any claim related to the service will not exceed the amount you paid us in the twelve months before the event giving rise to it or, if you use a free plan, 100 US dollars.
Nothing in these terms limits rights that the law of your country grants you as a consumer and that cannot be waived.
13Indemnification
If you are an issuer, you are responsible for third-party claims arising from the credentials you issued, the content you uploaded, or your breach of these terms, and you will hold BadgeClaimed harmless against them.
14Changes to these terms
We may update these terms. We will publish the new version on this page with its date and, if the change is significant, notify you by email or in the app before it takes effect. If you keep using the service afterward, you accept the new version.
15Governing law
These terms are governed by the laws of the United States of America. Before filing a formal claim, please email us: most issues are resolved by talking. If you are a consumer, you keep the protection that the law of your country of residence gives you.
